Overview of the Temu Data Class Action Lawsuit:

Whom: A class action complaint was brought by a group of customers against PDD Holdings Inc., formerly known as Pinduoduo Inc., and Whaleco Inc., doing business as Temu.

Why: According to users, Temu, an online shopping site controlled by China, gathers more data about its customers than is appropriate and more than it makes public.

Where: A federal court in Illinois received the class action case.


A recent class action complaint claims that Temu, an online shopping platform, obtains more customer data than is stated and goes beyond what is necessary.

A faction of Temu users contend that specialists have determined that Temu “consciously and purposely” included capabilities to its application that “perform harmful and virulent malware and spyware operations on user computers.”

“These experts claim that Temu gathers user data—including biometric data and data from app users—beyond what is required for an online shopping app,” the class action lawsuit claims.

Users of Temu wish to speak for a class of consumers that has utilized the platform nationally as well as subclasses of consumers in Illinois, California, and Virginia.

Class action lawsuit claims experts discovered Temu hides alleged privacy infringement

The class action claims that experts found Temu had “gone to extraordinary efforts” to hide purported privacy infractions from its consumers so it could keep stealing their data.

Users of Temu contend that since Temu is a Chinese-owned corporation and the data it gathers is “ultimately available to persons and entities in China,” the claimed privacy violations are particularly worrisome.

The Temu class action complaint claims that “under Chinese law, in turn, such user data held by, controlled by, or accessible to persons and businesses in China may be sought by the government at any time.”

Users of Temu assert that the corporation has violated many state laws, the Computer Fraud and Abuse Act, the Electronic Communications Privacy Act of 1986, and unjust enrichment.

The claims in the class action case, according to a Temu representative who talked with Top Class Actions, are mostly based on a report from a short-selling company that has a financial interest in spreading false and defamatory material.

The spokesman states, “We vehemently refute the claims included within it.” Moreover, class action lawsuits against Apple and Amazon have just been started by the same legal company.

The plaintiffs seek a judgment of compensatory, statutory, and punitive damages for themselves and every member of the class, as well as a jury trial and declaratory and injunctive relief.

Temu refuted a different lawsuit that Shein, a competitor online marketplace, filed last month. Shein alleged that Temu utilized hundreds of photographs that were protected by copyright as advertising images on its website.

The plaintiffs are represented by Douglas G. Smith of Aurelius Law Group LLC and Steve W. Berman and Jeannie Evans of Hagens Berman Sobol Shapiro LLP.

Ziboukh, et al. v. Whaleco Inc. d/b/a Temu, et al., Case No. 1:23-cv-15653, is the Temu data class action case in the U.S. District Court for the Northern District of Illinois.
